Our Data Privacy and Cyber Security Department is highly recognized in Mexico for its extensive experience and knowledge of the national and international legal framework, alongside international standards on the main practices related to Privacy, Data Protection and Technology Information regulations.  

We have a team of analytical attorneys who understand the importance of evolving as new technologies emerge, in order to design specific strategies that fit our client´s current situation, adding value to their business, reduce unnecessary risks, protect one of their most value assets and ensure compliance with the applicable regulations.

JDV has provided guidance to various industries on technological issues or in connection with digital environments, in particular telecommunications, electronic payment systems, pharmaceutical industry, fintech, institutes and universities, personnel search, selection platforms and publishers, among others. We draft and review contractual clauses and corporate agreements, set forth privacy notices and implement privacy policies for global corporate groups having complex personal data processing strategies.

Additionally, we have counseled transnational companies on implications of the General Data Protection Regulation (GDPR) and on issues related to the California Consumer Privacy Act.

Our Litigation practice has handled major cases related to proceedings filed by the National Institute of Transparency, Access to Information and Data Protection (INAI) which have set ongoing legal precedents. We have also put forward innovative strategies for contentious-administrative proceedings before the Federal Administrative Justice Court and the Federal Judicial Power.

One of the greatest strengths of our Privacy, Data Protection and IT practice is planning and executing custom projects, starting with a wide vision  that enables us working alongside key players within the organization, so that the    activities and internal processes are not being affected; always bearing in mind all legal obligations, criteria and recommendations of Data Protection Authority. Our attorneys are members of various associations related to Data Protection, such as the International Association of Privacy Professionals (IAPP); Chamber of Commerce of the United States of America (AMCHAM) in the respective Cybersecurity, Data Protection and Information Technologies committees

Practice Highlights

Jáuregui y Del Valle represented one of our clients in connection with a Data Subject´s request to exercise his right of cancelling his personal data according to the General Data Protection Regulations (GDPR). He argued that as an European Union citizen he had the right to do so, although the company was not based in Europe.  

Jáuregui y Del Valle counseled one of the most important Telecommunications companies regarding Data Subject Access Request received online, claiming to have accessed information regarding the mobile phone number of a legal entity.

Jáuregui y Del Valle represented one of the biggest companies  worldwide in a verification procedure before the INAI, related to the processing of an IMEI (International Mobile Electronic Identity) as a personal data. Data Protection Authority ruled that the company didn’t fail to comply the Law nor its Regulation.   

Jáuregui y Del Valle represented a Telecommunications company in a case concerning a data subject who applied for a job opening through the company’s international domain, claiming an illegal data transfer and non-compliance of data protection principles. After our legal advice, INAI determined that no violation had occurred and that data communication was made in accordance with the law.

Jáuregui y Del Valle advised several organizations on an alleged data breach, developing a work and containment plan that could determine the legal implications of a possible breach to their security measures and databases.
